Present-day problems in India requiring action

Police should not involve in family matters:

Police should restrict their activities to maintenance of law and order , traffic and crimes in the society. Police manpower should not be wasted and police attention should not be diverted from their main functions because of their present jurisdiction in family disputes. Taking into account the ever-increasing family disputes in the society such as disputes between lovers who allegedly agreed to marry and ever increasing disputes among married people, and especially considering the fact that interference of police in family matters invariably results in irrevocable spoiling of family life in many families, family disputes should be kept outside the jurisdiction of police. Government guidelines may be issued to the effect that police should not interfere in family matters including issues/problems BEFORE MARRIAGE and AFTER MARRIAGE, unless the issue/problem is murder or attempted murder.

Family welfare Department should replace police in family matters:

To take over the present work of Police Dept in family matters other than murder and attempted murder, a new department by name FAMILY WELFARE DEPT. may be started by the State Governments and the department should have one or more BOARDS in each district and the Board will consider the complaints of family disputes and try to settle the disputes by counselling and after counselling prepare a report/judgment on the complaint made to it. Each Board in the Family Welfare Dept should be comprised of three members, viz. a social worker/respectable member in the locality, a psychologist and a retired judge/retired law officer.

a) Any issues/problems BEFORE MARRIAGE AND AFTER MARRIAGE including (i) Refusal to marry after promise, (ii) Dowry harassment, (iii) cruelty, torture, domestic violence, (iv) any other complaints other than murder or attempted murder shall be referred to the said FAMILY WELFARE department and the Board would attempt to settle the issues/problems/complaints by COUNSELLING and a final report be GIVEN as to the outcome.

b) Any party aggrieved with the decision of the aforesaid board in the Family Welfare Department may either approach the Family court or arbitration. Like section 125 Cr P C (maintenance to spouse) and Guardianship and Wards Act( child custody etc), (a) Dowry matters and (b) Domestic Violence matters after the counselling by the FAMILY WELFARE dept. shall be agitated before the Family Court if any party is not accepting the final report/judgment given by the Board of Family Welfare Department after counselling.

Procedure for regulating Dowry prohibition Act:

In view of the fact that Dowry is a serious problem in the society, and the Dowry Prohibition Act is IN RECENT YEARS VERY MUCH MISUSED TO COERCE AND THREATEN INNOCENT PERSONS, it should be averted by appointing one or more Anti Dowry officer/s in each district under the control of aforesaid FAMILY WELFARE DEPT to whom all marriages should be reported at least 15 days before the marriage and a report SIGNED BY BRIDE, BRIDEGROOM AND PARENTS/GUARDIANS OF BRIDE AND BRIDEGROOM giving details of of gifts given to the bride and bridegroom at the time of marriage either as Sridhana property or otherwise including the quantum and details of JEWELS by the parents/guardians of both sides. If any further property was given to the woman after marriage, additional reports should be filed to the said officer.

Abetting suicide - an obsolete law:

Abetting suicide is a draconian law which has become obsolete and meaningless in the context of present day intelligence level of even children, growing depression and unjustifiable greed on the part of persons, be it man or woman, and consequent increase in suicides. The crime of abetting suicide should be taken cognizance only if the person who committed suicide is an insane person or a child. The unjust practice of arresting the husband and inlaws on the presumed or vague allegation of abetting suicide as and when a married woman dies should be dispensed with taking into account the present day realities of strange attitudes and dwindling character of people (mostly arising out of unjustifiable greed) as reported in Tamil newspapers in recent times.

Procedure for arrest in cases of vicarious liability:

Arrests by way of vicarious liability such as arrest of persons not directly involved in any accident/violence/etc. should be restricted by putting a condition that arrests in deserving cases should be made only after a verdict by a district/sessions judge after allowing the police and the accused abundant opportunity to present their respective cases.

Procedure for arrest in charges that are trivial or easy to fabricate:

Arrests for allegations like (a) cheating (b) threatening under Sec. 506 IPC and (c) trivial matters such as possessing pen camera /cell phone etc in court /public places etc. should be made only after a verdict by a district/sessions judge after allowing the police and the alleged wrongdoer abundant opportunity to present their respective cases.

Functioning of Govt. Departments:

All Government departments should reply to all requests/complaints by members of public within a period of not more than 30 days from the date of receipt of requests/complaints. In case the reply could not be given within the period of 30 days, an interim reply giving the reasons for the delay , approximate date of reply (not exceeding 60 days) should be given by the officials concerned. Statistics showing the number of requests/complaints received by each department, whether reply given within the stipulated time etc. should be exhibited in each office and/or in the website every week
